Terms and Conditions

§ 1 General Provisions
The online store Flotylion.pl, operating at https://www.flotylion.pl, is run by Kamil Łapaj Horse Care, with its registered office at E. Orzeszkowej 44/1, 42-100 Kłobuck, Poland, VAT ID (NIP): 5742028166, REGON: 241361174.
These Terms and Conditions define the rules for using the Online Store, in particular the rules for concluding sales agreements for products available in the Online Store, performing these agreements, and handling complaints.

Clients can contact the Seller using the details above. Phone support is available Monday to Friday, 08:00–17:00.

§ 3 Definitions

  • Order Form – an online tool on the Store’s website that allows the Client to purchase products, add items to the Cart, and define terms of the Sales Agreement, including delivery and payment methods.

  • Client – any natural person (including Consumers aged 13 or older with parental consent), legal person, or organizational unit with legal capacity using the Store’s services.

  • Consumer – a natural person purchasing products through the Online Store for purposes unrelated to their business or professional activity.

  • Entrepreneur – a natural or legal person, or organizational unit with legal capacity, conducting business or professional activity and entering into legal transactions related to that activity.

  • Client Account – a personalized panel created for each Client after registration.

  • Cart – a section of the Online Store where the Client can review selected products and modify data.

  • Online Store – the website www.flotylion.pl, through which Clients can purchase products from the Seller.

  • Seller – the entity defined in §1 that offers products via the Online Store.

  • Product – a movable item sold through the Online Store.

  • Sales Agreement – a distance contract for the sale of Products concluded via the Online Store.

§ 4 Registration and Login
The Seller provides Clients with the possibility to create and use a Client Account. Browsing products does not require an account. Orders can be placed with or without registration by providing the necessary personal and address details. Registration is voluntary and free of charge. Clients can delete their account at any time by notifying the Seller via email or post. Registration requires acceptance of these Terms and consent to personal data processing.

§ 5 Placing Orders
Clients can place orders 24/7 via the Order Form. Acceptance of these Terms is required to complete an order. Orders from Consumers or Entrepreneurs without the obligation of intra-community VAT reporting can only be delivered within Poland unless otherwise specified. The Seller confirms the order via email, at which point the Sales Agreement is concluded. Prepaid orders must be paid within 7 days, or they will be canceled. Special rules apply to certain transactions over 15,000 PLN involving VAT-registered Entrepreneurs (split payment mechanism). The Seller may cancel orders from non-Consumers within 7 days without reason.

§ 6 Product Prices
Prices are shown in PLN and EUR, inclusive of VAT. The binding price is the one displayed in the Cart at the time of order completion. Orders may only be delivered in Poland unless specified otherwise. The Seller reserves the right to refuse orders exceeding a yearly threshold for intra-community supplies.

§ 7 Order Fulfillment
Orders delivered within Poland are typically fulfilled within 3 business days from:

  • Payment on delivery – from the confirmation of order acceptance;

  • Prepayment – from confirmation of successful payment.

§ 8 Right of Withdrawal
Products made to individual specifications or personalized cannot be returned. For other products, Consumers may withdraw within 14 days. The withdrawal period starts upon delivery. Clients must notify the Seller and return products within 14 days. Refunds are issued using the same payment method unless agreed otherwise. Clients are responsible for reduced value due to improper use.

§ 9 Complaints
All products are new. The Seller is liable for defects under the Polish Civil Code. Complaints must be submitted in writing or electronically and should include product details, description of the defect, and Client information. Complaints are processed within 14 days.

§ 10 Out-of-Court Dispute Resolution
Consumers can use out-of-court dispute resolution through relevant authorities, social organizations, or European Consumer Centres. The Online Store agrees to participate voluntarily in these proceedings. For cross-border disputes, the ODR platform is available: http://www.ec.europa.eu/consumers/odr.

§ 11 Data Protection
The Seller is the administrator of Clients’ personal data. Data provision is voluntary but necessary to complete orders. Data is processed for order fulfillment and marketing (with consent). Clients can request access, correction, deletion, or restriction of their data, withdraw consent, and lodge complaints to the Data Protection Authority. Data is stored until consent is withdrawn. No data is transferred outside the EU.

§ 12 Final Provisions
Agreements are concluded in Polish. The Seller may amend the Terms for legal or organizational reasons, notifying Clients 15 days in advance. Existing agreements are governed by the Terms in effect at the time of order. Unregulated matters are subject to Polish law, including the Civil Code and Consumer Rights Act.
These Terms come into force on 25 November 2024.
